Did I mess up with the car accident?

I hit a pole with my car, and my cousin was in the backseat on the opposite side. Now his mom is telling the insurance company he got injured in the accident. Is there anything I can do to stop my insurance from going up because of this?

The insurance claim will likely affect your premium since you’re at fault unless you have accident forgiveness. Not sure what you mean by ‘messing up.’ But if you think your aunt is lying to get money, you might want to stop giving her and her kids rides. If asked, tell people you’re worried about the safety of the kids in your car and you’re too anxious about another accident.

@West
If you’re offering rides, make sure your aunt knows you’re happy to help out multiple times! She won’t look good in court when an attorney gets involved.

You can let the insurance know she’s lying and ask them to investigate. Lying to the insurance company can lead to penalties or even jail time.

Insurance fraud is serious business, for sure.

Personal injury attorneys often work with doctors who will exaggerate injuries. It might be tough to prove fraud in this case, though. The insurance company might pay based on doctors’ reports. But remember, the accident was your fault, so it’s likely the claim will go through anyway.

It could depend on what the medical records show about the kid’s injuries. A chiropractor could easily write up a long report of injuries, even for something minor.

No.

These things happen.

So your aunt is trying to get some money from your insurance… how are your parents handling this?

My mom and her had a big argument, they were cursing each other out.

Sometimes you have to keep enemies close. Your mom should call her back, act polite and ask what she can do to help. If your aunt is lying, she will slip up. The best witness will be a sister who calls her out.

@Noor
It’s not her sister, it’s her ex’s sister.

Your insurance premium is probably going up, but you should tell them that your aunt is lying. If you end up in court, try to get your cousin to get x-rays or something to prove the injury. It might be expensive, but it could help you out in the end. If you have proof of fraud, keep it safe.

Did you file a police report? Was the child checked by a doctor after the accident? I’m guessing an attorney is behind all this. If so, they might ask everyone in the car for a statement. Best case, the child says they weren’t hurt, but their mom said they were.

@Paxton
No police report, no medical check for the child.

Without a police report, it’s just one side’s word against the other. USAA might still pay out, but they might start at $10k for injury claims. If you didn’t report the accident, they’ll want an explanation. If you had any bodywork done, you’ll need to show how little damage there really was.

@Paxton
Wait, what’s this $10k?

That’s usually the starting amount they’ll offer for injury claims.

What does your cousin’s doctor say? Even small accidents can cause injuries that might not show up right away. Your premium will go up since you’re at fault, but before assuming your aunt is lying about the injuries, make sure the kid really isn’t hurt. If you live with them, keep an eye on him, but if they don’t, how do you know how serious the injuries are? She’s his mom and she knows him best.
