I’ve heard that you might be able to sue your car insurance company if they deny a claim, but is that even worth it? Has anyone here had experience with this? What steps do you take to make sure it’s even a valid option?
Yeah, you can sue them, but it’s a hassle. I looked into it when my insurance company denied a claim even though I had all the right coverage. Before you sue, make sure you’ve got all your paperwork in order and try appealing first. Sometimes it’s just an error on their part.
@Amanda
What kind of paperwork are you talking about? Like, do I need more than the claim denial letter?

You’ll need everything: your policy, the denial letter, any repair bills or medical bills, and any communications with your insurer. The more proof you have, the better.
Honestly, lawsuits can drag out for years. Mediation might be a better option if your insurer is dragging their feet. It’s faster, and you might still get some money out of it without the court drama.

How does mediation work? Do you still get the same amount as if you sued?
@Rowen
Not usually. You probably won’t get as much as you’d win in court, but it’s faster and less stressful. A third party hears both sides and decides based on the evidence.
My insurance denied my claim because they said I didn’t have the right coverage, but I’m sure I did. Turns out it was an error, and after I filed an appeal with more documentation, they finally paid up.
@Cade
What kind of docs did you send with your appeal? I’ve been thinking about appealing my own claim.

I sent everything—photos, witness statements, police reports, and repair estimates. Anything that backed up my claim.
If your insurer is just taking forever to review your claim, you might want to reach out to a lawyer. Sometimes that’s enough to make them move faster, even if you don’t end up actually suing.

That’s good to know! I’ve been waiting for what feels like forever for them to finish reviewing my claim.
@Darwin
Yeah, it’s worth looking into. Just make sure the lawyer specializes in car insurance stuff. They’ll know how to get things moving.
