Anyone else having trouble with delayed claims?

I got into an accident months ago, and they determined fault to be 50/50. But they never contacted my witness or even looked into the police report, which clearly stated it wasn’t my fault. When I asked if they had contacted the witness, they said they couldn’t reach them. However, my attorney got in touch with the witness several times. This whole process is taking forever, and I’m really thinking about filing a complaint with the New Mexico Department of Insurance. I’m just frustrated with how insurance companies treat people.

Not the same situation, but I get what you’re going through. USAA, if you’re reading this, it’s time to step up. We’ve been loyal customers for over 40 years, as have our parents and siblings. We used to recommend USAA all the time. But after the way our latest claim was handled, I’m done. It was a mess—lots of delays, unreturned calls, wrong paperwork, and an unhelpful agent. For the first time in 40 years, we’re thinking of switching companies.

Was your witness just a random third party? Were they listed in the police report? Can they call your adjuster or USAA to set up a time?

Yes, they were listed in the police report.

Good to hear. Sounds like your lawyer needs to get more involved! They should be getting more answers from USAA. Are they sure USAA has the right contact info for the witness? That’s something your lawyer could clarify.

I’m in the same boat. I’m on month 3 of paying for insurance on a car that will be declared a total loss.

If you’re this close to filing a complaint with the New Mexico Department of Insurance, just go for it. Drop the hammer.

You should report both your adjuster and USAA to the FTC and FBI for fraud. If they want to play games, make them pay for it.

To clarify: OP has a 50/50 fault determination, but it was clearly not their fault according to the police report. USAA didn’t even talk to the witness, even though the witness was listed in the police report. USAA is dragging their feet. So yeah, OP has every right to be upset about this.

Okay, I get it now. I didn’t realize the witness was listed in the police report. I was just going off the post. It sounds frustrating, and I hope it gets resolved soon. Sorry for misunderstanding.
