State Farm won’t let me take my soon-to-be ex-wife off the policy

Keep paying it and ask the judge to make her pay it back when you finalize the divorce. Talk to your lawyer about it.

This is the same for health insurance too. It’s illegal to take her off until the divorce is final.

If both sides agree and it’s an uncontested divorce, the process should be quicker.

There are several legal issues to deal with here.

In many states, you share liability as long as you’re married. Some states won’t let you exclude a spouse from an insurance policy until the divorce is finalized. You’re still considered a married couple legally.

If you read your homeowners policy, she’s probably covered as a household member, even if she’s not listed. Some companies would require you to list her or might not renew your policy. If you’re in a state that allows exclusions, some companies will do it, others won’t, because there’s still a risk. She still needs to insure any cars she drives, or you’ll share liability.

Just a heads up, your rates will likely go up when you’re single.

Depending on your state’s laws, if she gets into an accident, you could be liable if you’re still married.

There’s a good reason for this. It stops one spouse from screwing over the other, like leaving them without insurance.

Do not try to remove your wife or her car from the policy. She’s a Named Insured and can’t be removed.

Your agent must stay neutral in this. If something happens and she doesn’t have coverage, your agent could get in trouble. It could also come back to hurt you in the divorce.

Best option: Take yourself and your car off the policy and start a new one for yourself. Remove your payment info from the old policy. Ask your agent to explain the billing carefully, so you don’t end up in a dispute over unpaid premiums.

Also, maybe don’t get married again!
