Same thing happened to me. A commercial vehicle rear-ended me and totaled my car. I thought about suing the driver’s business, but my lawyer said it wouldn’t be worth it. I filed with my insurance, and it took years to get it sorted, but it worked out in the end.

File with your insurance. They’ll reach out to the other guy’s insurance, find out it’s lapsed, and treat it like an uninsured driver claim. They’ll fix your car and probably sue the guy later. Let them deal with it.

Your insurance can send him to collections if he doesn’t pay up.

If he was at fault, your insurance will go after him. That’s why you have uninsured motorist coverage.

File the claim. You can shop around for new insurance now, just in case your current provider drops you.

How much was your last payout? If it was for an older car with a smaller payout, I wouldn’t worry. But if it was for a newer car, you might have an issue.

Yeah, I’ve got that coverage, so I shouldn’t have any issue. It’s just really frustrating that it could lead to higher premiums or losing coverage due to too many claims.
