i’m in new york and have geico insurance. someone hit my car and refused to give their license and insurance info, which counts as hit and run here.
so i want to know…if i have his name, phone number, license plate, and photos of the damage on both our cars, will my insurance still make me pay my deductible? i’ve got full coverage, including uninsured motorist, but my deductible is more than the repair itself. that’s why i’m asking.
first thing…did you file a police report? without one, your insurance will probably stick you with the deductible unless they can go after the other driver’s insurance. even then, they won’t bother unless there’s a police report.

no, i didn’t file one. is it too late to do that? and even if i file it, does that mean i’ll get my deductible back?
you can still file a report, but you’re gonna pay the deductible. the chances of getting it back are really slim.
you could hand over all the info to your insurance, but you’ll still pay the deductible upfront to the repair shop. getting it back depends on whether he’s insured, has assets, or anything your insurance can pursue. even if you get it back, it’ll take a while.
if you use your collision coverage, you’ll have to pay your deductible, since NY doesn’t require uninsured motorist property damage coverage. deductible is just part of your coverage choice, doesn’t matter who’s at fault. after you pay, your insurance might go after the other driver to get back what they paid, including your deductible.
yes, regardless of fault, your insurance company will make you pay the deductible.
but if the other driver’s insurance admits fault, then your insurance might either waive the deductible or give it back after they recover costs from the other insurance company.
yes, if your insurance covers the repair, you’ll owe the deductible. it doesn’t matter if it’s hit and run or anything else, it’s just the amount you agreed to pay in your claim.
